Mary Trump suggested that Attorney General Merrick Garland was an "idiot" for not yet prosecuting her uncle, former President Donald Trump, over the Capitol riot.
Speaking on "The Dean Obeidallah Show" on Friday, Mary Trump said it was "dangerous" of the Justice Department not to indict her uncle for inciting his followers to violently challenge the certification of President Joe Biden's election.
"The problem is this is the last time it's going to happen — this is literally our last opportunity," she said. "I thought the Department of Justice was supposed to be about justice but Merrick Garland seems to have deluded himself into believing that by not pursuing this he's somehow taking the politics out of the Department of Justice."
She said: "I have something to say to you then, Mr. Garland: You think it's not a political decision not to pursue, not to investigate the second-worst insurrection ... in US history? I mean, that's not a political decision?"
"And the fact that he doesn't understand that or that he doesn't care, or that he's an 'institutionalist' because that apparently gives you free license to be an idiot, I don't know."
Legal experts and former DOJ officials previously told Insider's C. Ryan Barber they were struck by Garland's apparent lack of scrutiny of the former president over the Capitol riot.
Garland, whom Biden appointed a day after the insurrection, has maintained that his first priority was restoring the Justice Department's reputation as an apolitical body.
When Biden told reporters in October that he hoped the DOJ would prosecute those who defy subpoenas from the House's January 6 commission, Garland's spokesperson said the department would "make its own independent decisions in all prosecutions based solely on the facts and the law."
Mary Trump's comments come as the House select committee continues to make progress in its investigation of the insurrection, subpoenaing multiple Trump aides for documents and testimony.
Last month, the DOJ indicted Steve Bannon on two counts of contempt of Congress for defying subpoenas.
Mary Trump has long been openly critical of her uncle and his policies, and has since 2020 published two books about him.
